Response Ready Fire Systems LLC dba EmberHawk Sprinklers ("EmberHawk," "we," "us") respects your privacy. This policy explains what personal information we collect, how we use and disclose it, and the choices you have.
This policy applies to emberhawksprinklers.com and to our sales, support, and marketing activities. It does not apply to third-party sites we link to.
1. Personal information we collect
Identifiers — name, billing and shipping address, email address, telephone number, account credentials, IP address, device identifiers, cookie IDs, and advertising IDs.
Commercial information — products viewed and purchased, order history, cart contents, return and warranty records, and customer service correspondence.
Internet and network activity — pages viewed, referring and exit pages, search terms, clicks, scroll depth, session duration, browser and device type, operating system, and interactions with our emails and ads.
Approximate geolocation — general location inferred from IP address, used for shipping estimates, tax, fraud screening, and regional relevance. We do not collect precise GPS location.
Payment information — card payments are processed by our payment processor. We do not store full payment card numbers on our systems. We receive a transaction confirmation, the last four digits, card brand, and billing ZIP code.
Communications — the content of emails, chats, form submissions, calls, reviews, and photos you send us.
Inferences — preferences and characteristics derived from the above, used for product recommendations and advertising audiences.
We do not knowingly collect sensitive personal information as defined by California law (such as Social Security numbers, precise geolocation, racial or ethnic origin, health data, or account log-in credentials paired with security codes) beyond what is necessary to process your order and secure your account, and we do not use or disclose sensitive personal information for purposes requiring a right to limit.
2. Sources
Directly from you; automatically from your device as you use the Site; from service providers (payment processor, shipping carriers, fraud prevention, e-commerce platform, email and SMS providers, analytics and advertising partners); and from publicly available sources.
3. How we use personal information
- Process, fulfill, ship, and support your orders, returns, and warranty claims
- Communicate with you about orders, shipping, recalls, and safety notices
- Provide customer service and respond to inquiries
- Detect, investigate, and prevent fraud, abuse, and security incidents
- Operate, maintain, analyze, and improve the Site and our products
- Send marketing communications where permitted, and measure their effectiveness
- Deliver and measure targeted advertising, including retargeting on third-party platforms
- Comply with legal obligations, enforce our terms, and establish or defend legal claims
4. Cookies and tracking technologies
We use cookies, pixels, tags, SDKs, local storage, and similar technologies:
- Strictly necessary — cart, checkout, login, security, load balancing. These cannot be disabled.
- Functional — remember preferences such as region and saved settings.
- Analytics — understand how the Site is used and improve it.
- Advertising and retargeting — including pixels and tags operated by Meta (Facebook/Instagram), Google, and TikTok — to show you EmberHawk ads on other sites and platforms and to measure ad performance.
You can control cookies through our cookie banner and preference center, and through your browser settings. Blocking strictly necessary cookies will break checkout.
Global Privacy Control. We honor the Global Privacy Control (GPC) signal. If your browser or extension transmits GPC, we treat it as a request to opt out of the sale and sharing of personal information for that browser and device.
Do Not Track. We do not respond to legacy browser "Do Not Track" signals, which lack a common standard. We do honor GPC as described above.
5. Disclosure of personal information
In the past 12 months we have disclosed the categories of personal information above to:
- Service providers and contractors acting on our behalf — e-commerce platform and hosting, payment processing, fraud prevention, shipping and logistics carriers, email and SMS providers, customer support tools, analytics providers, and professional advisors. These parties are contractually restricted to using the information only to perform services for us.
- Advertising partners — Meta, Google, TikTok, and similar platforms, for cross-context behavioral advertising and measurement.
- Legal and safety recipients — where required by law, subpoena, court order, or government request; to enforce our terms; to protect the rights, property, or safety of EmberHawk, our customers, or the public; and in connection with an investigation of suspected fraud.
- Business transfers — in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business.
6. Sale and sharing of personal information
We do not sell personal information for money.
However, under the California Consumer Privacy Act as amended, our use of advertising pixels and tags to deliver targeted ads may qualify as "selling" and constitutes "sharing" for cross-context behavioral advertising. The categories involved are identifiers, commercial information, internet and network activity, approximate geolocation, and inferences.
You may opt out at any time using the "Your Privacy Choices" link in our site footer, by enabling Global Privacy Control in your browser, or by emailing sales@emberhawksprinklers.com.
We do not sell or share the personal information of consumers we know to be under 16 years of age.
7. Your California privacy rights
If you are a California resident, you have the right to:
- Know the categories and specific pieces of personal information we have collected, the sources, the business purposes, and the categories of third parties involved;
- Delete personal information we collected from you, subject to exceptions such as completing a transaction, providing warranty service, security, and legal compliance;
- Correct inaccurate personal information;
- Opt out of the sale and sharing of personal information for cross-context behavioral advertising;
- Limit the use and disclosure of sensitive personal information (we do not use sensitive personal information for purposes that trigger this right);
- Non-discrimination — we will not deny you goods or services, charge a different price, or provide a different quality of service because you exercised a privacy right.
How to exercise your rights. Email sales@emberhawksprinklers.com with the subject line "Privacy Request," or call 877-347-3732. To protect your information, we will verify your identity by matching the information you provide against our records, typically your email address and order details. Authorized agents may submit requests on your behalf with written permission signed by you and verification of the agent's identity. We will respond within 45 days, and may extend once by an additional 45 days with notice.
Shine the Light. California Civil Code § 1798.83 permits California residents to request information about disclosure of personal information to third parties for their direct marketing purposes. Send requests to the contact above.
8. Rights in other states
Residents of other states with comprehensive privacy laws may have similar rights to access, correct, delete, obtain a portable copy of, and opt out of targeted advertising and profiling. Use the same contact methods above, and identify your state of residence. Where required, you may appeal a denied request by replying to our response with the subject line "Privacy Appeal."
9. Marketing communications
Email. You may unsubscribe from marketing emails at any time via the link in any message. We will still send transactional messages about your orders, returns, warranty claims, and safety notices.
SMS. If you opt in to text messages, message and data rates may apply, message frequency varies, and consent is not a condition of purchase. Reply STOP to unsubscribe and HELP for help.
Mobile information and text messaging
If you provide your mobile phone number and consent to receive text messages, we use that number to contact you about your sprinkler recommendation, respond to your inquiries, and provide order updates.
We do not sell, rent, or share mobile phone numbers or SMS consent information with third parties or affiliates for their own marketing or promotional purposes. Mobile numbers may be shared only with service providers who help us deliver messages on our behalf, and those providers are prohibited from using the information for any other purpose.
You may opt out of text messages at any time by replying STOP to any message, emailing sales@emberhawksprinklers.com, or calling 877-347-3732. Opting out of text messages does not affect your ability to purchase from us or to receive email or phone communication.
We retain records of SMS consent, including the date, time, and the consent language displayed at the time you opted in, for as long as required to comply with applicable law.
10. Data retention
We retain personal information for as long as needed for the purposes described here — generally, order and warranty records for at least the length of the warranty period plus the applicable limitations period, tax and accounting records as required by law, and marketing data until you unsubscribe or request deletion. We then delete or de-identify it.
11. Security
We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach of unencrypted personal information occurs, we will notify affected California residents as required by California Civil Code § 1798.82.
12. Children's privacy
The Site is intended for adults. We do not knowingly collect personal information from children under 13, and we do not sell or share the personal information of anyone under 16. If you believe a child has provided us information, contact us and we will delete it.
13. Third-party links
The Site may link to third-party websites and platforms. We are not responsible for their privacy practices. Review their policies before providing information.
14. Changes to this policy
We may update this policy. Material changes will be posted here with a revised "Last updated" date and, where required, communicated to you directly.
