Warranty

This Limited Warranty is provided by Response Ready Fire Systems LLC, doing business as EmberHawk Sprinklers ("EmberHawk," "we," "us"), Redding, California.

What is covered

EmberHawk warrants that its sprinkler products (each, a "Product") will be free from defects in materials and workmanship under normal use and service for a period of one (1) year from the date of delivery to the original purchaser.

Who is covered

This Limited Warranty extends only to the original retail purchaser who bought the Product directly from EmberHawk or an EmberHawk-authorized reseller, and is not transferable. Proof of purchase is required.

What we will do

If a Product is found to be defective during the warranty period, EmberHawk will, at its sole option, either (a) repair the Product, (b) replace the Product or the defective component with a new or refurbished equivalent, or (c) if repair and replacement are not commercially practicable, refund the amount you actually paid for the defective Product.

Repair, replacement, or refund of the purchase price is your sole and exclusive remedy under this Limited Warranty. Replacement parts are warranted for the remainder of the original one-year period, not for a new one-year term.

How to make a claim

1. Email sales@emberhawksprinklers.com within the warranty period and before returning anything.
2. Include your order number, proof of purchase, a description of the problem, and clear photographs of the Product as installed and of the defect.
3. We will issue a Return Merchandise Authorization (RMA) number if a return is required. Products returned without an RMA number will be refused.
4. If we confirm a covered defect, we will provide a prepaid return label. If inspection shows the failure is not covered by this Limited Warranty, you are responsible for return shipping in both directions.

Water supply

EmberHawk operates on municipal supply, wells, and pump-fed storage. Mineral scaling from hard water can affect spray performance over time; this is normal maintenance and isn't covered under warranty. Rinsing the head with clean water after each use prevents most of it.

Test it before you mount it

Hook it to a hose and run it on the ground first, that's all it takes to know it works. Once it's mounted we can't take it back, so make sure you're happy before you drill. See our Returns & Refunds policy.

What is NOT covered

This Limited Warranty does not cover, and EmberHawk is not responsible for:

• Installation that does not follow EmberHawk's written instructions, or installation performed in a manner inconsistent with the Product's rated specifications;
• Operation at water pressure or flow outside the Product's published operating range, including operation with a booster pump or pressure source exceeding the rated maximum;
• Freeze damage, including cracking, splitting, or seal failure caused by water left in the Product in freezing conditions;
• Mineral scaling, sediment, debris, or corrosion from untreated surface water, pool water, greywater, recycled or non-potable water, or water containing sand, silt, or organic matter;
• Damage from exposure to fire, extreme heat, radiant heat, smoke, ember contact, or firefighting operations;
• Damage from impact, falling limbs, animals, vandalism, theft, wind, hail, snow load, seismic events, vehicle contact, or other external causes;
• Normal wear, UV weathering, fading, discoloration, oxidation, and other cosmetic changes that do not affect function;
• Any Product that has been modified, altered, disassembled, repaired by anyone other than EmberHawk or an EmberHawk-authorized party, or that has had its markings removed or defaced;
• Products purchased from an unauthorized reseller, or acquired used, secondhand, at auction, or as-is;
• Consumable and wear items, including gaskets, washers, O-rings, filter screens, and fasteners;
• Labor to remove, reinstall, access, or re-commission a Product, including any crane, lift, roof access, scaffolding, or contractor cost;
• Any loss, cost, or damage arising from the Product's performance or non-performance during a wildfire or other fire event.

No warranty of fire protection

EmberHawk does not warrant, represent, or guarantee that any Product will prevent, suppress, extinguish, contain, or reduce loss or damage from wildfire, ember intrusion, structure fire, or any other fire event. No Product is a fire suppression system, is not listed or certified to NFPA 13, 13D, or 13R, and is not a substitute for defensible space, building hardening, code-required fire protection systems, professional firefighting, or evacuation. Limitation on implied warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO ONE (1) YEAR FROM THE DATE OF DELIVERY — THE SAME DURATION AS THIS EXPRESS LIMITED WARRANTY.

Some states and jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Limitation of damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBERHAWK IS NOT LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO ANY PRODUCT OR THIS LIMITED WARRANTY, INCLUDING DAMAGE TO REAL OR PERSONAL PROPERTY, LOSS OF USE, LOSS OF STRUCTURE, WATER DAMAGE, LOSS OF WATER SUPPLY, INCREASED INSURANCE COST, LOSS OF INCOME, OR COST OF SUBSTITUTE GOODS OR SERVICES.

IN NO EVENT WILL EMBERHAWK'S TOTAL LIABILITY UNDER THIS LIMITED WARRANTY EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some states and jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above may not apply to you. Nothing in this Limited Warranty excludes or limits liability for personal injury or death where such exclusion or limitation is prohibited by applicable law, or for fraud, willful injury, or violation of law.

Your legal rights

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
